Our firm frequently reviews the online records of the Clerks of the Circuit Courts throughout Florida which indicate that the number of mortgage foreclosure lawsuits being filed has drastically risen in recent months. Many creditors often employ the services of certain debt collectors whose collection activities and practices may have violated your valuable legal rights under the Federal Fair Debt Collection Practices Act, 15 U.S.C §1692 et seq., the Florida Consumer Collection Practices Act, Fla. Stat. §559.55 et seq. or other consumer protection statutes in connection with the mortgage foreclosure process.
In the event we are able to establish violations of these consumer protection laws, as to you individually, by any of these debt collectors, you may be entitled to a money judgment for your actual damages and statutory damages of $1,000.00. In some cases, violations may appear in frequently used debt collection and mortgage foreclosure form letters which have been sent to many consumers such as you. In these instances, a class action lawsuit may be appropriate, which if successful, would entitle you, as a member of the class of injured consumers, to share in damages of up to the lesser of $500,000.00 or one percent (1%) of the net worth of the debt collector. Protection of your legal rights may involve more than just money. We may also be able to assist you with: reducing or eliminating repetitive, annoying collection telephone calls; preventing other abusive or harassing collection activities; and, correcting false or misleading representations made by these debt collectors in connection with a mortgage foreclosure.
The advice of an attorney will allow you to be fully informed of your rights under applicable Federal and Florida laws relating to the debt collection and mortgage foreclosure process. Saxon, Gilmore, Carraway, Gibbons, Lash & Wilcox, P.A. would welcome the opportunity to meet with you to advise you of your rights. We offer a completely free initial consultation to explain the particular consumer rights violations we believe exist and the courses of action that you may take and damages you may claim. In most cases, it won’t cost you a dime to hire an attorney because, when a violation is established, the debt collector is required by law to pay your attorneys’ fees and reasonable costs. Additionally, we represent a number of consumer clients under contingent fee arrangements, where they are not responsible for any attorneys’ fees or costs unless we recover from the debt collector.
Involving an attorney with experience with consumer rights and mortgage foreclosure issues may result in an early resolution of your case, thus avoiding the necessity of trial. In fact, most consumer rights debt collection cases are resolved through settlement or mediation. However, if a trial is necessary we have considerable experience with consumer debt collection litigation cases.
